This Privacy Policy explains how PAKGENIE CORP ("PakGenie", "we", "us" or "our") collects, uses, shares and protects personal information when you visit pakgenie.com (the "Site"), use our design studio, or order Products from us. It should be read together with our Terms of Service.

1. Information we collect

Information you give us

  • Contact and account details: your name, business name, email address and phone number.
  • Order details: the Products, options and quantities you order, billing and delivery addresses, order notes, and your communications with us about proofs and orders.
  • Your designs: artwork, logos, images and text you upload, designs you create in our studio, and the descriptions or prompts you enter into our AI design tools.
  • Messages: information you include when you email us or request support.

Payment information. Payments are processed by our e-commerce platform and its payment processors at checkout. We do not receive or store your full card number.

Information collected automatically

  • Device and usage data: IP address, browser and device type, pages viewed, links clicked, referring pages, and the date and time of your visit.
  • Local storage: we store your shopping cart in your browser so it is still there when you return. You can clear it at any time in your browser settings.
  • Analytics: we use privacy-focused website analytics to understand how the Site is used, such as which pages are visited. We do not use this data to build advertising profiles.

Information from others. Our checkout and payment providers tell us whether a payment succeeded and share the order details you entered at checkout. Shipping carriers may share delivery status updates.

2. How we use information

We use personal information to:

  • Process, produce, ship and support your orders, including preparing proofs and handling cancellations, reprints and refunds.
  • Create designs and design suggestions with our studio and AI design tools.
  • Communicate with you about your orders, proofs, account and requests.
  • Send marketing emails if you have agreed to receive them. You can unsubscribe at any time.
  • Operate, maintain, secure and improve the Site and our Products.
  • Detect and prevent fraud, abuse and security incidents.
  • Comply with legal obligations, enforce our Terms, and protect our rights and the rights of others.

3. How we share information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

We share personal information only as needed to run our business, with:

  • Service providers who work on our behalf, including our e-commerce and checkout platform (Shopify), payment processors, website hosting and security (Cloudflare), database and file storage (Supabase), and email providers.
  • AI technology providers who process your design prompts and uploads to generate design results, such as Anthropic and Recraft. They process this data to provide the service to us.
  • Production and shipping partners who print and deliver your order. They receive your design files and the delivery details needed to fulfil your order.
  • Professional advisers such as lawyers and accountants, under confidentiality obligations.
  • Authorities and others when required by law, or when we believe disclosure is needed to protect the rights, property or safety of PakGenie, our customers or others.
  • A successor business if PakGenie is involved in a merger, acquisition, financing or sale of assets, subject to this Privacy Policy.

4. Your designs

We use your designs and uploads to create proofs and produce your order, to provide support, and to keep records of what was approved and printed. We do not use your designs in our marketing or show them to other customers without your permission.

5. How long we keep information

We keep personal information for as long as needed for the purposes described in this policy, including to fulfil orders, allow reorders, provide support, and meet legal, tax and accounting requirements. Order and transaction records are generally kept for at least 7 years. Designs and uploads are kept so you can reorder, unless you ask us to delete them. When information is no longer needed, we delete or de-identify it.

6. How we protect information

We use reasonable administrative, technical and physical safeguards to protect personal information, including encrypted connections (HTTPS) and access controls. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

7. Your choices and rights

  • Marketing emails: you can unsubscribe using the link in any marketing email or by contacting us. We will still send messages about your orders.
  • Access, correction and deletion: you can ask us for a copy of the personal information we hold about you, to correct it, or to delete it, subject to legal exceptions (for example, records we must keep for tax purposes).
  • Browser controls: you can clear local storage and block or delete cookies in your browser settings. Some parts of the Site, such as your cart, may not work as expected.

Depending on where you live, you may have additional rights under state privacy laws, such as the right to know what personal information we collect and how we use it, to obtain a copy, to correct or delete it, and to opt out of the sale or sharing of personal information or targeted advertising. We do not sell personal information or use it for targeted advertising. We will not discriminate against you for exercising your rights.

To make a request, email hello@pakgenie.com. We may need to verify your identity before responding. You may use an authorized agent to make a request on your behalf, and we may ask for proof of their authorization. If we deny your request, you may appeal by replying to our decision.

8. Children

The Site is intended for businesses and adults. It is not directed to children under 16, and we do not knowingly collect personal information from children. If you believe a child has given us personal information, please contact us and we will delete it.

9. Location of processing

PakGenie is based in the United States and our Site is intended for customers in the United States. Personal information is processed and stored in the United States and in other countries where our service providers operate.

The Site may link to websites and services we do not control, such as our checkout provider. Their privacy practices are governed by their own policies.

11. Changes to this policy

We may update this Privacy Policy from time to time. We will post the updated policy on this page with a new "Last updated" date, and where changes are significant we will provide additional notice.
